1.  I understand that the sport of golf and other recreational activities associated with it, like Speedgolf, can be dangerous and involve the risks of injury and death. I understand that these risks include, but are not limited to, the risks normally associated with playing golf and/or running. In consideration of joining the Speedgolf USA Speedgolf-friendly Course Network, I agree to expressly release from liability Speedgolf USA, and its owners, employees, agents, contractors, landowners, sponsors, and affiliated companies (collectively referred to as “SGUSA”) for any damage, injury, or death that occurs as a result of any person playing Speedgolf at my facility during the term of my membership. Furthermore, to the fullest extent allowed by law, I agree never to sue SGUSA, regardless of cause, including the NEGLIGENCE of SGUSA.

2. I agree that all Speedgolf activities undertaken at my facility are conducted at the player's own risk. Furthermore, in the same or similar manner as employed for customers playing golf, I agree to inform and make Speedgolf customers aware of the risks involved with participation in Speedgolf. 

3. I understand this is a release of liability that is valid FOREVER. I understand that this Release of Liability will prevent me or anyone associated with my facility from making any claim for damages in the event of injury or death arising out of participation in Speedgolf activities at my facility. Additionally, I agree to defend, indemnify, and hold harmless SGUSA for any damages, attorneys’ fees, or costs associated with or arising out of a lawsuit.

4. With a complete and full understanding of this release of liability, I nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon me, my facility, heirs, assigns, legal representatives, and any other person acting on my behalf. I also agree to indemnify SGUSA for any and all claims brought by a third party which arise from offering Speedgolf at my facility

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND HOLD HARMLESS AGREEMENT. I FULLY UNDERSTAND ITS TERMS, AND I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME, AND BY CHOOSING 'I AGREE' I INTEND TO COMPLETELY AND UNCONDITIONALLY RELEASE SGUSA OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
